These terms and conditions constitute an agreement between the user or registered user of this site ("You") and the European Space Agency ("ESA"), with head office at 8/10 rue Mario Nikis, 75738 Paris cedex, France.

Access to, and use of, the ESA NAVIPEDIA website constitutes acceptance of the following general terms and conditions. Neither ESA nor any other party involved in creating, producing or delivering the website shall be liable for any direct, incidental, consequential, indirect or punitive damages arising out of your access to, or use of, the website. The ESA NAVIPEDIA web site does not guarantee the accuracy of any content, information and data whether provided by ESA or by external sources and accepts no responsibility or liability for any consequences arising from the use of such content, information and data. While ESA tries to maintain a high level of technical operability and security of the ESA NAVIPEDIA, we inform you that you browse and use the website at your own risk. PERSONAL DATA PRIVACY
By accessing the ESA NAVIPEDIA website, certain information about users, such as internet protocol (IP) addresses, navigation through the site, software used and time spent, as well as other similar information, will be stored on ESA servers. These will not specifically identify users and the information will be used internally for website traffic analysis only. USE OF IP ADDRESS
The IP address is a number that is automatically given to your computer when you are surfing on the internet. Servers and ‘big computers’ that host web pages, automatically identify your computer through its IP number. ESA uses IP addresses in order to carry out statistics, however, as IP addresses and personal identification are not linked to each other users remains anonymous.

FORUMS AND DISCUSSIONS
From time to time the ESA NAVIPEDIA contains bulletin boards, chat rooms, access to mailing lists and other message and communication facilities (collectively termed 'forums'). Users agree to use forums only to send and receive messages and materials that are strictly related to the particular forum. When using an ESA forum users agree not to do any of the following:
- Users shall not download, distribute or otherwise publish through NAVIPEDIA any content which is libellous, defamatory, obscene, pornographic, abusive or in any way violates any laws.
- Forums are for non-commercial use only. Users shall not distribute or otherwise publish any material containing any solicitation for funding, advertising or solicitation for goods or services without requesting and receiving prior written approval from ESA.
- Users shall not delete any author attributions, legal notices, proprietary designations or labels from any file that is downloaded nor falsify the origin or source of software or other material contained in a file that is downloaded.
Users shall remain solely responsible for the content of their messages. ESA does not and cannot review every message posted by users on forums and is not responsible for the content of any messages posted. ESA reserves the right to delete, move or edit, at its sole discretion, any message posted by a user.
Users shall be aware that all forums and discussion groups are public and not private communications. Further, users acknowledge that chats, postings, conferences and any other form of communication by other users are not endorsed by ESA, and that such communications shall not be considered as having been reviewed, screened or approved by ESA.
The view expressed in forums and discussion groups shall in no way be considered as reflecting an official opinion or statement of the European Space Agency.
COPYRIGHTS
Content available on ESA NAVIPEDIA is intended for Your personal and non-commercial use.
Content published by You or by another user on the ESA NAVIPEDIA may be protected by intellectual property rights (IP content). You undertake to observe all intellectual property rights relating to IP content, in particular any restrictions regarding the right to copy, use, distribute, reproduce, modify, adapt, publicly perform and publicly display such content. You may not have a permission to copy use, distribute, reproduce, modify, adapt, publicly perform and publicly display IP content available on ESA NAVIPEDIA unless You have obtained a specific authorisation in this respect by the copyright holder.
Nothing herein shall be construed as granting or implying any rights to You on the IP content owned by ESA or by any third party credited as the copyright holder of the content.
ESA does not claim ownership of content You submit or make available for inclusion in the ESA NAVIPEDIA. However, with respect to IP content You submit (Your IP content) or make available for inclusion on ESA NAVIPEDIA, You grant ESA non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such content (in whole or in part) on the ESA NAVIPEDIA and to incorporate Your IP content into other works in any format or medium now known or later developed. This license exists only for as long as You elect to continue to include Your IP content on the ESA NAVIPEDIA and will terminate at the time You remove or ESA removes Your IP content from the ESA NAVIPEDIA, unless Your IP content has been shared with others and they have not deleted it.
Hold Harmless
You agree to indemnify and hold ESA and its Member States harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of a direct or indirect infringement of such a third party’s intellectual property rights related to IP Content, available on the ESA NAVIPEDIA, that You may have copied, used, distributed, reproduced, modified, adapted, publicly performed and publicly displayed, sold, or redistributed in violation of these terms and conditions, or in violation of such third party’s rights.
Use of ESA logo
The ESA logo is owned by ESA and protected by trademarks and under Article 6ter of the Paris Convention for the Protection of Industrial Property. You may not modify or create derivatives of the ESA logo. Any use, reproduction, publication, display, transmission, making available to the public or exploitation of the ESA logo requires prior written authorisation. Miscellaneous Provisions
Should any provision of these Terms and Conditions be found to be invalid, illegal or unenforceable under the laws of any relevant jurisdiction, the invalid or unenforceable provision shall be given no effect but the remaining provisions of these Terms and Conditions shall remain in full force and effect.
Without prejudice to the applicability of the ESA Convention and in particular its Annex I on privileges and immunities of ESA, these Terms and Conditions shall be governed and interpreted in accordance with the laws of France. All disputes arising out of, or in connection with, the present letter shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules. The language of arbitration shall be English. The place of arbitration shall be Paris, France.
